Voluntary Planning Agreement Register

Section 25F (1) and (2) of the Environmental Planning and Assessment Regulation 2000, states that a Council must keep a planning agreement register.

 


Council must keep a record of the following in its register:

  • a short description of any VPA (including any amendment) that applies to the area of the Council,

  • the date the agreement was entered into,

  • the names of the parties, and

  • the land to which it applies.

Harrington Grove

Short description:

The Agreement includes the conservation of two heritage homesteads (Harrington Park Homestead and Orielton) on the site and large areas of Cumberland Plain Woodland throughout the site. Facilities including land for District Playing Fields (Narellan Sporting Hub), cycleways/pedestrian paths, lookouts and fitness stations are included under the Agreement. A range of other facilities will also be provided under community title, including a Country Club, neighbourhood centres with pools and hard courts, parks and playgrounds. A monetary contribution is also required under the Agreement.

Oran Park Urban Release Area

Short description:

The Agreement contains works and land dedications with a value in excess of $140million (and excluding the value of the water cycle management works and land & the riparian corridor works and land). The Agreement provides all the local recreation/open space, community facilities, roads and drainage required to support this new community. It also includes the delivery of the Oran Park library, community centre, youth recreation centre and leisure centre.

Short description:

The Agreement provides for the provision of two nine hole golf courses surrounding the residential development, one on the west portion of lands and the other on the east portion of lands. VPA Deferrals & Variations

Voluntary planning agreements (VPAs) may contain clauses enabling a developer to defer or vary obligations under a Planning Agreement. 

  • Deferral of Works is an option in a VPA available to a Developer that intends to defer or delay the delivery of Works beyond the obligations specified in the Planning Agreement Schedule of Works.
  • Variation of Works is an option in a VPA available to a Developer that intends to vary the design or specification of any Work that is required to be carried out under a Planning Agreement. 

Developers must apply to Council in writing if they wish to defer or vary their obligations under a VPA.
