Camden Local Environmental Plan (LEP) Review 2020

Background

In March 2018, the State Government released the Greater Sydney Region Plan – A Metropolis of Three Cities, and the Western City District Plan, which includes the Camden LGA.

The District Plan is structured around the themes of:

  • Infrastructure and Collaboration;
  • Liveability;
  • Productivity; and
  • Sustainability.

In accordance with the District Plan and changes to the Environmental Planning and Assessment Act 1979 (the Act), all councils were required to review and update their Local Environmental Plans (LEP) and prepare Local Strategic Planning Statements (LSPS). This project is now known as the Comprehensive LEP Review 2020 and will be undertaken over the next two years until July 2020.

The LEP review program, developed by Greater Sydney Commission (GSC) and Department of Planning, Industry and Environment (the Department), identified six phases for the completion of the LEP review:

  • Phase 1 – LEP Review.
  • Phase 2 – Draft LSPS.
  • Phase 3 – Final LSPS.
  • Phase 4 – LEP Amendment Gateway Determination.
  • Phase 5 – Exhibition of Planning Proposal.
  • Phase 6 – LEP Amendment Plan Making.

What is a Local Environmental Plan?

A Local Environmental Plan is the principal legal document for controlling development in a Local Government Area (LGA). Councils prepare LEPs to establish different zones that allow certain types of uses and standards that regulate what kind of development can happen.

LEP Review Report

The LEP Review Report, was endorsed by Council on 30 October 2018 and submitted to the GSC. The LEP Review Report provided a snapshot of how the Camden LEP 2010 and Council’s plans, policies and programs align with the priorities and actions within the District Plan.

On 21 December 2018, the GSC provided confirmation that Council’s LEP Review Report complied with the Phase 1 Assurance for the LEP review program.

Local Strategic Planning Statement

On 9 July 2019, Council considered a report and resolved to endorse the draft LSPS for public exhibition and that a further report be prepared for Council to consider the outcome of the public exhibition and finalisation of the draft LSPS. The GSC issued a letter of support for the making of the Camden LSPS on 5 March 2020.

On 14 April 2020, Council resolved to adopt the Local Strategic Planning Statement.

LEP Amendment

Council has chosen to undertake the Comprehensive LEP Review in two stages.

Stage 1 to amend Camden LEP 2010 involves aligning with the State Government’s direction and, in particular the planning priorities outlined within the District Plan and draft LSPS. The Stage 1 Planning Proposal also includes minor amendments to improve the readability and application of Camden LEP 2010.

Stage 2 to amend Camden LEP 2010 will be undertaken following the completion of the technical strategy work required to fully align Camden LEP 2010 with the District Plan and draft LSPS. The following work is currently being undertaken to inform the Stage 2 Planning Proposal:

  • Housing Strategy;
  • Employment and Centres Strategy;
  • Green and Blue Grid Analysis;
  • Heritage Review; and
  • Scenic and Visual Analysis.

Council will seek input on these strategies later in 2020.

Stage 1 LEP Amendment – Public Exhibition

On 8 October 2019, Council endorsed the Stage 1 Planning Proposal for Gateway Determination by the Department of Planning, Industry and Environment. The Gateway Determination was received on 28 February 2020 and a Gateway Alteration was received on 15 May 2020.

Stage 1 of the Camden LEP Review is currently on public exhibition until 21 July 2020. More information regarding the public exhibition of the Stage 1 amendment can be viewed here.
