Terms and Conditions

Hirer responsibilities and actions

  • The hirer must be over 18 years of age to book the unit(s) and agree to be bound by all the Terms and Conditions. 
  • Adhere to any current State and Federally mandated COVID-19 requirements and any other Public Health Orders. 
  • The portable water fountain/ water refill unit(s) available are for use within the Camden Local Government Area only. Hirer must not use, transport, store or in any other capacity possess unit(s) outside the Camden Local Government Area. 
  • Specifications of the portable water fountain/ water refill unit have been outlined in this request form. It is the responsibility of the hirer to ensure that the unit(s) selected meet the needs of the hirer and event. 
  • The provided instruction document and safety checklist (available on Camden Councils booking portal) must be read and understood prior to use of unit(s).
  • The hirer must accept responsibility for any claim, arising from damage or accidents, which may occur during your possession of the portable water fountain and/or water bottle refill unit and any associated equipment or parts and is liable for the restoration of any damage resulting from these activities. 
  • To obtain any consent or approval from relevant government, statutory bodies in regard to the use and installation of the unit(s) at a site. 
  • To ensure the site is suitable for the installation of the unit(s) when they are installing. Camden Council takes no responsibility for incorrect assembly, setup or use and any damage to the unit(s) will be charged in full to the hirer. 
  • Not to make or permit any unauthorised alterations to the unit(s). 
  • The hirer shall protect the unit(s) from the elements during the hire period. 
  • To return the unit(s) to Council at the expiration of the booking period in the same condition as when the hirer first received it. 
  • Upon collection of the unit(s) and until return of the unit(s) to Camden Council the hirer has full responsibility of the unit(s). The hirer shall pay full replacement cost of any unit(s) that is damaged, lost or stolen. The replacement or repair of any damaged unit(s) will be determined by Camden Council and invoiced to cost if cost exceeds bond held. 
  • Proper care of the unit(s) will be taken during transportation, set-up and pack-down. 
  • Ensure correct manual handling procedure and safety is implemented when collecting, installing, disassembling and in any capacity in possession of the portable water bubbler and/or water refill unit(s). 
  • The unit(s) will not be left unsupervised or left overnight without appropriate security. 
  • In the event of an emergency, please contact the appropriate emergency service provider on 000 and ensure all incidents, accidents or near misses are reported to Council by email at customer.service@camden.nsw.gov.au For assistance, please contact Council on 4654 7777 during business hours. If assistance is required after Council’s business hours, please contact Council’s after-hours service on 4654 7777. 
  • Please note that requests for the unit(s) are managed through Camden Council’s Sustainability Team and availability is subject to existing bookings and maintenance schedules. 
  • The hirer must complete and sign the Request for Hire and Indemnity Agreement before being permitted to use the unit(s). 
  • Inappropriate behaviour or a breach of these terms and conditions or the Request for Hire and Indemnity Agreement may result in the immediate cancellation of the booking or future bookings at the discretion of Council.

Water unit specific terms and conditions

  • To take responsibility to ensure that only a drinking water (potable) source is used.
  • There is access to a mains water tap at event location to hook water stations in to. The mains water tap has a thread to attach the hose to (i.e. it is not a self-closing tap).
  • Water Stations will not be set-up near live exposed electrical connections/wiring or in high wind areas.
  • Water hoses that pass over traffic areas will be covered by trip hazard hose covers.
  • Water will be flushed through unit(s) before use and at the beginning of each day.
  • Water stations, fittings and hoses will be emptied of water, cleaned and dried before being packed into carry bag and returned to Camden Council.
  • It is the responsibility of the hirer to keep the equipment in a hygienic, clean and safe working order.
  • To pack down the unit in accordance with the instructions provided by Council.
  • The collection and return checklist must be completed by Camden Council and the hirer as part of the hire agreement.

Collection, set up and return

  • Units are to be collected the business day prior to event date from Council’s Sustainability Team at 70 Central Ave, Oran Park between 9:30am – 4:30pm Monday to Friday. 
  • Please allow half an hour to run through paperwork when arranging suitable times for collection and return. 
  • They are to be returned the business day after the event concludes to Sustainability Team at 70 Central Ave, Oran Park between 9:30am – 4:30pm Monday to Friday. 
  • To pack down the unit in accordance with the instructions provided by Council. 
  • The collection and return form attached below must be completed by Camden Council and the hirer as part of the booking agreement.

Fees and bond

  • Hire agreements are not confirmed until full payment of bond is received.
  • No tentative agreements for hire will be accepted.
  • Bond fees are subject to annual review and new fees are applicable as adopted for all bookings made from 1st July each year.
  • The bond fee is $105 PER UNIT.
  • Hire of both the portable drinking fountain and bottle refill unit will incur a total bond fee of $210.
  • Additional equipment does not incur associated bond, however, is subject to any costs associated with damage listed under the terms and conditions. 
  • Please note: Bond fees will only be processed once the hirer has returned all equipment to Council and an inspection of hired equipment is deemed satisfactory. Council reserves the right to withhold part or complete bond where there are breaches of conditions of hire, or there are costs incurred as a result of the hire. Bond fees will be refunded via electronic funds transfer (EFT) and can take up to 10 working days.

Damage

  • In the event the portable drinking fountain and/or bottle refill station and associated equipment is damaged when in the possession of the hirer, the hirer agrees to pay for each individual item of equipment damaged and this includes but is not limited to:
    • Mysterious disappearance; or
    • Where equipment is not adequately secured; or
    • Burglary or theft; or
    • Misuse, abuse, wilful and malicious acts and reckless and negligent use of equipment; or
    • Graffiti, posters, stickers; or
    • Equipment damage is beyond repair; and
    • The hirer is responsible for the full replacement value.
  • All damages must be paid within 30 days of the hire period or otherwise agreed with Camden Council.
  • It is the hirers responsibility to notify Camden Council should the equipment not be in a satisfactory condition on the same day of receiving the equipment, otherwise any damage of equipment shall be deemed the hirers accountability.
  • Any damage to the portable drinking fountain and/or bottle refill station must be reported to Camden Council by email at sustainability@camden.nsw.gov.au and, where possible, include photos of the damage. For assistance, please contact Council on 4654 7777 during business hours.

Cancellation and amendments to hire

  • The hirer may cancel the booking at any time.
  • All cancellations and requests for amendments should be emailed to the Sustainability team on sustainability@camden.nsw.gov.au

We encourage you to

  • Pre-promote Camden Councils portable water bubblers and/or water refill unit(s) so event attendees know to bring a reusable water bottle or cup. 
  • Use signage (and/or feather flags) at your event to allow attendees to easily find water stations and include water station locations on event maps. 
  • Announce water stations and encourage use at events. 
  • Acknowledge Camden Council for providing the unit(s).

Please note the units have a maximum booking period of 5 days.

Collection and return will be available from the Sustainability Team at 70 Central Ave, Oran Park between 9:30am – 4:30pm Monday to Friday.

Collection and return of unit(s) are not available on weekends.

For weekend hire, the water unit(s) must be collected the business day prior to event and returned the business day post event.

Please allow approximately half an hour to run through paperwork when arranging suitable times for collection and return.

Exact collection and return time will be confirmed with hirer after assessing the hire application and is subject to the availability of the Sustainability Team.

Section 7 - Payment method

Over the phone - a member of our Customer Relations Team will call you to take your credit card payment when processing your application/request.

In person – to make payment in person attend one of Council’s Customer Service Hubs at:

  • Camden Council (main office) – 70 Central Ave, Oran Park

Payment methods include cash, cheque, money order, EFTPOS and credit cards/ 

Note: All credit card transactions have a 0.76% Merchant Service Fee applicable

Section 8 - Request for hire and indemnity agreement

Before the portable drinking fountain and/or bottle refill station will be issued please ensure that you have read the terms and conditions of hire carefully before completing the request for hire and indemnity agreement.

I, the hirer has read and understood the terms and conditions of the request for hire for the use of the portable drinking fountain and/or bottle refill station and I agree and acknowledge the following:

  • I hereby agree to indemnify Camden Council against all claims directly or indirectly arising from, or incurred in connection with, damage to or loss of property, or injury, or death while the portable drinking fountain and/or bottle refill station is in my possession.
  • I acknowledge that the period the portable drinking fountain and/or bottle refill station is deemed to be in my possession extends to and includes the collection and return process and storage.
  • I acknowledge that I will take due care and follow the provided instructions.
  • I acknowledge that I have read and understood the Instruction guide and safety checklist and will abide by all requirements.
  • I understand my responsibilities in relation to the hire of the unit(s) and that any breach of these terms and conditions will result in the full or partial loss of my bond and payment of any additional charges in accordance with the terms and conditions of hire.

Council reserves the right to deny or cancel any request for hire that it considers inappropriate.

Failure to abide by the terms and conditions of the request for hire may result in partial or full loss of bond, and payment of any additional charges arising in accordance with the terms and conditions of hire.
